Zhejiang Communications Administration Bureau: Announcement on Issues Related to Value-Added Telecommunications Business License

In order to continue to promote the reform of "decentralization, regulation and service" and continuously optimize the business environment, the following announcements are made in response to the daily corporate consultation matters received by our bureau:

1. Issues regarding the need to apply for a Value-added Telecommunications Business License

According to the relevant statutory requirements for the establishment and implementation of administrative licenses, enterprises applying for value-added telecommunications service licenses must meet the conditions established in relevant regulations such as the Telecommunications Regulations, the Classification Catalog of Telecommunications Services, and the Administrative Measures for Telecommunications Business Licensing. If it does not belong to a business form that requires permission in accordance with the law or if the enterprise application materials do not meet the necessary conditions, our bureau will not permit it in accordance with the law.According to relevant regulations and the requirements of the Ministry of Industry and Information Technology, the following business forms do not require the "Value-added Telecommunications Business Business License":

1. If an enterprise uses its own website and directly sells its own or other enterprises 'goods or services in a self-operated manner, and no other unit or individual enters the website in its own name to carry out sales, value-added telecommunications services are not involved and there is no need to obtain the "Value-added Telecommunications Business Operation License".

2. An enterprise uses its own website to publish information related to the enterprise itself. It does not provide platform services for other units or individual users to publish information. It does not involve value-added telecommunications services and does not need to obtain a "Value-added Telecommunications Service Operation License".

3. Enterprises rely on WeChat, Alipay and other Internet platformsMini programsIf business is operated in the form of, public accounts or applications relying on smart terminal equipment, and there is no other independent operation platform, value-added telecommunications services will not be involved and there is no need to obtain a "Value-added Telecommunications Service Operation License".

Our bureau calls on purchasing demanders or service providers to reasonably set the selection conditions for partners to avoid adding unreasonable burdens to relevant business operators.

4. Enterprises rely on their own Internet platform to integrate and allocate transportation resources, sign an agreement with the shipper as a carrier, and entrust the actual carrier to complete road transportation business activities. They do not involve value-added telecommunications services and do not need to obtain a "Value-added Telecommunications Business Operation License".

5. The following three situations are not considered to be operating call center business and do not need to apply for a business license:

1. We only provide consulting and other services to our own customers and do not provide related services to third-party customers. For example, service-oriented enterprises such as banking, insurance, securities, logistics, and civil aviation use the 95/96 customer service short numbers they apply for to carry out services related to their own businesses.

2. Only human outsourcing services such as operators are provided, and no call center system is established.

3. It only provides technical services such as building a call center system on its behalf.

2. Issues related to the application for intermediaries and fees for the "Value-added Telecommunications Business License"

Our bureau has never designated any third party to provide intermediary services for applying for the "Value-added Telecommunications Business License", nor has it charged any fees to the applicant. For any enterprise's application, our bureau will review it on time in accordance with laws and regulations, and will continue to improve the efficiency of approval. Our bureau encourages enterprises to submit application materials through the system themselves so as to obtain our bureau's review opinions and follow-up regulatory requirements in a timely manner.

3. Issues regarding the implementation of the pilot project of business license approval notification and commitment for telecommunications services (Category II value-added telecommunications services) in the Free Trade Zone

According to the deployment of the Ministry of Industry and Information Technology, our bureau will continuously optimize administrative approval services and implement a pilot notification commitment for the approval of business licenses for telecommunications services (Category II value-added telecommunications services) within the scope of the Free Trade Zone of Zhejiang Province.

4. Issues on strengthening supervision during and after the event

Our bureau will continue to strengthen supervision during and after the event, and will deal with those who apply for telecommunications business licenses in the form of concealing relevant information, providing false materials, etc., or who obtain telecommunications business licenses through unfair means such as fraud or bribery, or who fail to fulfill their commitments made in advance to improve relevant materials or measures after obtaining telecommunications business licenses, our bureau will severely deal with them in accordance with the law.
